1. Scope
These terms apply to all contracts between Hoffmann Metal Construction & Industrial Services and the client – whether private or business.
2. Offers and Contract Conclusion
Offers are non-binding and valid for 14 days. Acceptance by the client requires written confirmation and a down payment, the amount of which is agreed individually (e.g. material costs).
3. Prices and Surcharges
All prices are net plus VAT. Overtime (after 8 hours/day or over 40 hours/week) will be charged with a 25% surcharge. Work on Sundays and public holidays is also subject to a 25% surcharge.
Travel costs are charged at €0.70/km. Overnight flat rate within Germany: €60/night. For international assignments, different rates apply. Expenses are to be covered by the client.
4. Payment
Invoices are payable within 7 days after completion of work, without deductions. In case of late payment, we reserve the right to charge interest on arrears.
5. Defects and Warranty
Obvious defects must be reported in writing within 7 days after acceptance. If the claim is justified, we will remedy the defect. Further claims – especially for damages – are excluded as far as legally permissible.
6. Retention of Title
Delivered goods remain our property until full payment has been made.
7. Final Provisions
German law applies. Jurisdiction – where permitted – is our company’s registered office. If any provision is invalid, the remaining provisions remain unaffected.
